305 This appendix discusses grounds under state laws to involuntarily terminate parental rights, usually because of abuse, neglect, abandonment and other grounds that cause harm to children, such as the abuse and neglect of other children or the long- term alcohol or drug-induced incapacity of the parent(s). Other grounds for termination may be a long-term felony conviction, the mental illness of a parent, the failure to provide financial support to a child and so on.
The Adoption and Safe Families Act (ASFA) requires state agencies to terminate parental rights when children have been in foster care for 15 of the most recent 22 months as well as in other cases, such as when a child is an abandoned infant or the parent has murdered another child or the child’s other parent or has solicited such a murder or when the parent has committed a felony assault that has caused serious physical harm to the child or to another child of the parent.
Exceptions to ASFA may be made, such as when the child is in the care of another relative, when it is believed that terminating parental rights is not in the child’s best interests and when the parent has not been provided with services required by the case plan toward reunification of the parent with the child.

ALABAMA
• The parent has abandoned the child.
• The parent is unable to discharge his or her parental duties due to
• Emotional illness, mental illness or mental deficiency
• Use of alcohol or controlled substances
• A conviction and incarceration for a felony
• The parent has tortured, abused or severely mal- treated the child.
• The parent’s conduct or neglect has resulted in serious physical injury to the child.
• The parent has subjected the child to an aggra- vated circumstance, including, but not limited to, abandonment, torture, chronic abuse, substance abuse or sexual abuse.
• Reasonable efforts to rehabilitate the parent have failed.
• The parent has been convicted of
• Murder or voluntary manslaughter of another child of the parent
• Aiding, abetting, attempting or soliciting to commit murder or voluntary manslaughter of another child of the parent
• A felony assault that results in serious bodily injury to the child or another child of the parent
• The parent has failed to support the child when financially able to do so.
• The parent has failed to maintain regular visita- tion, contact or communication with the child.
• Parental rights to another child have been invol- untarily terminated.
